The products offered by Dial4sms include, but are not limited to, Messaging Tools or Interfaces (such as Web Browser Interface, Microsoft Excel Plug-in, 2-Way Messaging, Unicode Tool, API Tools, Short Code, Virtual Long Number, etc.), developed either by Dial4sms or any other third party, Sender Name/Number, and Message Credits.
The services provided by Dial4sms consist of, but are not limited to, SMS Core Messaging Platform Access, Data Encryption, Data Transmission, Data Access, Data Storage, and, where applicable, Synchronization Software.
Users are responsible for obtaining and maintaining all necessary computer hardware, software, and communications equipment required to access the Products and/or Services, as well as for paying any applicable access charges (e.g., telecommunications) incurred while using the Products and/or Services.
Dial4sms offers some of its Products and/or Services free of charge, while others are offered for a fee. All price details are prominently displayed and must be paid upfront before activating the account and/or specific feature(s) and/or credits. The price per SMS may vary periodically based on changes made by operators. Dial4sms does not guarantee uninterrupted and continuous availability of the Products and/or Services or any specific feature(s) thereof. SMS prices may also vary if operators introduce interconnection or DLT charges, with these price changes being applied to existing credits.
Dial4sms provides Application Programming Interface (API) Tools such as HTTP/S, XML, SMTP, and/or SMPP Protocol to connect to the Dial4sms Core Messaging Platform. These tools offer an easy, efficient, and flexible integration option with the User’s website/application, enabling auto-generated SMS text messages to be delivered to intended recipients’ mobile phones. Dial4sms charges a one-time setup fee or a periodic fee based on the selected package for activating such connectivity.
Additionally, Dial4sms offers lifetime validity for some of its Products and/or Services, which remain valid for a period of 5 years with annual renewal by minimum quantity purchase.
Any special offers and/or discounts introduced by Dial4sms are valid only for the specified validity period mentioned in the offer. Dial4sms may or may not extend the offer once it reaches its expiration date.
Dial4sms also provides an option to receive SMS text messages into the User’s Dial4sms account (referred to as Inbox). Dial4sms may charge up to one credit for each incoming message into the User’s account.
The Products and/or Services are provided “AS IS” and are subject to the disclaimers of warranty and limitations of liability as found in this agreement. Users are advised to test the Products and/or Services before entering into this agreement.
Dial4sms reserves the right to change or terminate the Products and/or Services and/or alter the Terms and Conditions of this Agreement at any time with or without notice and/or with immediate effect.
SINGLE USER ACCOUNT:
To access and use Dial4sms Products and/or Services, Users need to have a Dial4sms Account (“account”). For this account, the User needs to complete a simple one-time registration process by providing all current, complete, and accurate information as prompted by the Registration Form. Entering inaccurate details might result in suspension or blockage of the account. The User has to choose his/her unique “username” and “password” (each not less than three characters).
To avail connectivity using API Tools and/or SMPP Protocol, Users need to fill in another form containing details such as IP Address to connect to the server, Technical Contact Information, Type of API, etc.
Dial4sms reserves the right to approve Users for connectivity using API Tools and/or SMPP Protocol at its sole discretion. Although Dial4sms shall provide connection specifications and shall attempt to keep the specifications accurate and up-to-date, these specifications may be incomplete and may change from time to time without Dial4sms informing the Users about the changes. It is the User’s sole responsibility to regularly test the specifications thoroughly, and Dial4sms shall not accept responsibility for any specifications that may be incorrect or incomplete.
Users are entirely responsible for maintaining the confidentiality of their password and account information. Additionally, Users are entirely responsible for any and all activities that occur under their accounts. Dial4sms shall not be held liable for any third-party claims and/or actions taken with respect to the Products and/or Services being offered. Users agree to notify Dial4sms immediately regarding any unauthorized use of their accounts or any other breach of security.
If Dial4sms finds no activity in any User’s account for more than 365 days, that account shall be temporarily blocked or suspended. Users may contact Dial4sms to reactivate such accounts.
USER OBLIGATIONS AND DUTIES:
Dial4sms expressly prohibits any unauthorized commercial use of the Products and/or Services. Users agree to abide by all applicable local, national, and international laws and regulations and are solely responsible for all acts or omissions (that occur under their account or password), including responsibility for the content of any transmissions through Dial4sms.
Users acknowledge that Dial4sms and its licensors retain ownership of all proprietary applications, software, intellectual property “IP” (Intellectual Property), and any portions or copies thereof in relation to them, as well as all rights therein.
Dial4sms provides, by way of example and not as a limitation, the stipulation that Users agree not to, directly or indirectly:
Reverse engineer, decompile, disassemble, or otherwise attempt to establish the source code or the underlying ideas or algorithms of the Products and/or Services;
Modify, translate, or create distinctive and derivative works based on the Products and/or Services;
Copy (except for archival purposes), rent, lease, distribute, assign, or otherwise transfer rights to the Products and/or Services;
Use the Products and/or Services for time-sharing or to the benefit of a third party;
Remove any proprietary notices or labels that identify Dial4sms Products and/or Services;
Use the Services in any way connected to any chain letters, junk SMS text messages, spam, or any unsolicited messages (commercial or otherwise);
Harvest or otherwise collect information about other Users, including email addresses, without obtaining their consent;
Transmit any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material of any kind or nature;
Transmit any material that infringes on the intellectual property rights or other rights of third parties, including any trademark, copyright, or right of publicity;
Defame or slander any person, or attempt to infringe upon any person’s privacy rights;
Transmit any material that may contain viruses, Trojan horses, worms, time bombs, cancel bots, or any other harmful or deleterious programs;
Interfere with or disrupt the networks connected to Dial4sms or violate the regulations, policies, or procedures of such networks;
Attempt to gain unauthorized access to the Products and/or Services or to other accounts, computer systems, or networks connected to Dial4sms;
Interfere with another User’s peaceful use and enjoyment of the Products and/or Services; or
Engage in any other activity that Dial4sms could believe may subject it to criminal liability, civil penalty, or judgment.
USER PRIVACY:
Dial4sms respects the privacy of Users and assures that it shall not monitor, edit, or disclose any personal information about Users or about Users’ Dial4sms accounts, including all contents, without Users’ prior permission. However, this will not apply if Dial4sms has to:
Conform to statutory and/or legal requirements or comply with the legal process;
Protect and defend the rights or property of Dial4sms;
Enforce this Agreement or protect Dial4sms business or reputation, including, without limitation, upon termination, cancellation, or suspension of this Agreement by Dial4sms;
Respond to requests for identification in connection with claims of copyright or trademark infringement by Users or to claims by third parties that Users are using the Products and/or Services in connection with an infringement, illegal, or improper activity; or
Act to protect the interests of Users or any others in general.
Users agree that Dial4sms can access their account, including the message content, as stated above or respond to product-specific queries or technical issues.
Users hereby permit Dial4sms to send them communication via email/SMS/WhatsApp of any updates, upgrades, notices, or any other information, including promotional offers, that Dial4sms deems important for Users to know, relating to the Products and/or Services.
Users of Dial4sms agree to all Terms & Conditions upon signup on our website and applications.
Using the our Services, User may get SMS, WhatsApp, Voice calls using recorded messages sent via mobile application from Dial4SMS.
